By accessing or using Khwand AI services, you agree to be bound by these Terms of Service. IF YOU DO NOT AGREE TO ALL TERMS, YOU MAY NOT ACCESS OR USE OUR SERVICES. These terms constitute a legally binding agreement between you and Khwand AI.
2. Service Description
Khwand AI provides an Agentic Lifecycle Management (ALM) platform for AI agent testing, monitoring, and optimization. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without notice or liability.
3. User Accounts and Responsibilities
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account.
4. Acceptable Use
You agree not to use our services for any illegal, harmful, or unauthorized purposes. Prohibited activities include but are not limited to: reverse engineering, unauthorized access attempts, distributing malware, or violating applicable laws. We reserve the right to terminate access for violations without notice or refund.
5. Intellectual Property
All content, software, and materials provided through our services are owned by Khwand AI or our licensors and are protected by intellectual property laws. You receive no ownership rights or licenses except for limited access to use the service as expressly permitted.
6. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KHWAND AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
8. Indemnification
You agree to indemnify, defend, and hold harmless Khwand AI and its affiliates, officers, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these terms, or your violation of any rights of a third party.

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Khwand AI is incorporated, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction.

We may modify these Terms of Service at any time without prior notice. Continued use of our services after changes constitutes acceptance of the revised terms. It is your responsibility to review these terms periodically.
